What the Section 13U enhanced-tier scheme is

The enhanced-tier scheme is provided under the Income Tax Act 1947, and Section 13U of that Act establishes an exemption for the specified income of an approved fund from designated investments, without the same restriction on fund residence that applies to the entry-tier scheme. It replaced the former Section 13X scheme.

Because it accommodates non-Singapore-resident funds and a broader range of structures, 13U is the route of choice for larger family offices, master-feeder arrangements and funds that expect to admit co-investors.

Eligibility: the higher commitments

Approval under the enhanced-tier scheme requires a substantially larger minimum fund size than the entry-tier scheme, a higher minimum annual local business spend, and a larger complement of Singapore-based investment professionals. The fund must be managed by a Singapore fund manager holding the appropriate licence or exemption.

MAS also assesses substance, governance and the family’s source of wealth. The enhanced-tier commitments are reviewed periodically, so applicants should confirm the prevailing thresholds before submission.

Documents required

Application fees for professional support commonly range from S$40,000 to S$90,000, reflecting the additional structuring work. Annual audit, administration and compliance are higher than for the entry-tier scheme, frequently S$80,000 to S$200,000, driven by the larger local-spending commitment.

Expect four to six months to approval from a complete submission. The exact minimum assets, spending and headcount figures are set by MAS; verify them at the Monetary Authority of Singapore and check the income-tax treatment of distributions at the Inland Revenue Authority of Singapore (IRAS) before committing capital.

Common mistakes and the relocation dimension

The main error is applying for the enhanced-tier scheme when the family cannot realistically sustain the higher spending and headcount, then falling out of compliance in year two. Model the running commitments over at least three years before choosing this tier.
