Your Company Is Asked to Produce Documents as a Witness: Check the Court Order Before Responding

Wooden gavel on a dark surface

A company can hold important evidence in a dispute without being the business sued. If a court order requires documents or witness attendance, read the actual order promptly and obtain advice on compliance. Do not treat it as an ordinary customer request, and do not assume sending a few PDFs removes any requirement to attend.

Identify what the court has ordered

The Singapore Courts’ witness guidance distinguishes orders requiring testimony, production of documents, or both. Some document-production orders do not require personal attendance. The wording of your order, the court and applicable procedure determine the response.

Example: a logistics company holds delivery records

Two trading companies dispute whether goods arrived. Their logistics provider receives an order concerning delivery records and driver evidence. Its task is to identify the records and the person with relevant knowledge, not to decide which trader deserves to win.

Preserve originals and locate the right custodian

Create working copies for review without altering originals. Avoid asking staff to rewrite old notes into a more convenient account of events.

Raise scope, confidentiality and privilege questions properly

Company records may contain unrelated customer information or communications that require legal review. Confidentiality and legal professional privilege are different issues. Do not assume that labelling a file confidential automatically excuses compliance, or that an order permits unrestricted circulation outside its purpose.

Ask for clarification through the proper route

If the documents are unavailable, the recipient is wrong or the request is unclear, have counsel check the available procedural response promptly. Do not silently substitute your own narrower scope. An email to the requesting party alone does not establish that the court changed its order.

Prepare the witness without supplying a script

A witness should distinguish personal knowledge, records reviewed and matters they cannot recall. Arrange practical attendance and document handling, and retain proof of what was produced. Keep assumptions separate from facts.

Must every document custodian attend court?

Not necessarily. Check whether the order requires documents only, attendance only or both.

Can we ignore it because we are not being sued?

No. Obtain advice on the order and the required response even when the company is not a party.
