A Promotion Letter and the Old Employment Contract Conflict: Reconcile the Terms

Colleagues discussing documents in a meeting

If a promotion letter conflicts with an existing employment contract, identify what was actually proposed and agreed. Do not assume every old term disappeared or every new HR-system entry became binding.

Review the documents with the employee and obtain legal advice where the contractual position is uncertain.

Compare the changed terms

Check role, duties, salary, working arrangements, benefits, notice and any additional obligations. Identify the effective date and whether the letter says other terms continue.

MOM’s guidance states that employers cannot change contract terms without employee consent and recommends clearly documenting agreed new terms.

Example: the HR system shows a longer notice period

The promotion letter changes the title and pay, but the HR database also increases notice. Establish the source of that change and whether it was actually agreed. A system setting is not a substitute for the contract review.

Prepare the reconciliation pack

Keep a clear distinction between acknowledging receipt and agreeing to a proposed variation where that matters on the facts.

Document the resolved position

Use an appropriately drafted document explaining which terms change and which continue. Avoid silently substituting a new contract version in the folder.

If the parties disagree, seek advice on the actual options and applicable obligations. Do not use a disputed variation as a reason for an unrelated salary deduction.

Update linked systems accurately

Once the position is established, align payroll, benefits, reporting lines and relevant official records. Retain the genuine agreement and effective-date evidence.

Review the next payslip and HR output to ensure the implementation matches what was agreed.

Does a promotion automatically change the notice period?

Check the agreed terms and applicable law.

Can HR software settle a contractual disagreement?

No. Resolve the underlying position first.
