When an employee asks to leave before the notice period ends, confirm whether the parties agree to waive notice, require payment in lieu, use annual leave or follow another lawful arrangement. Those outcomes are different. Record the agreed last day and financial position clearly before payroll or HR treats an informal conversation as a completed agreement.

Start with the resignation and contract
Keep the written notice, relevant contract and dates. Identify who requested the earlier departure and what response was given.
MOM’s notice guidance distinguishes serving notice, paying salary in lieu and a mutually agreed waiver, which should be recorded in writing.
Example: “you may leave Friday” is unclear
An employee asks to finish two weeks early. The manager agrees by message without discussing notice pay. Clarify what was actually intended rather than later assuming the employee waived money or admitted a debt.
If the employer is directing an earlier departure instead, obtain advice on that different situation. Do not disguise an employer decision as the employee’s request.
Document the practical terms
- Original notice and expected last day.
- Revised last day and the agreed basis.
- Notice waived or any payment in lieu.
- Earned salary, leave and other amounts requiring review.
- Handover, property return and access changes.
- Any relevant work-pass or tax-clearance steps.
Use language both parties can understand. A broad “full settlement” paragraph may introduce legal consequences beyond agreeing a departure date and deserves review.
Do not confuse annual leave with an earlier termination
MOM distinguishes approved leave during notice from agreed leave used to offset notice and bring forward the last day. Confirm which arrangement applies before allowing a new job to start or calculating the final payment.
Check the actual leave balance and obtain agreement where required. Do not silently change approved paid leave into unpaid absence.
Make payroll match the agreement
Give payroll the final document and effective dates. Review salary earned during notice separately from salary in lieu, including their applicable contribution treatment.
Retain the calculation, payslip and payment evidence. If the employee disputes a term, preserve the correspondence and obtain advice instead of making an unexplained deduction.
Does agreeing an earlier date automatically waive notice pay?
Confirm the actual agreement and relevant legal position.
Is clearing leave necessarily the same as leaving employment earlier?
No. Review the agreed arrangement and its consequences.
