Moving an Employment Pass holder to another group company requires more than changing a payroll code. Identify the legal employer, use the appropriate work-pass process and agree a clear cut-off for the employment records.

MOM’s EP update guidance explains that a related company applies for a new EP for the transfer. A full merger, acquisition or amalgamation uses the relevant change-of-business-entity process instead. Confirm the actual transaction before choosing the route.
Identify the employer on each side
Compare the existing employment contract, pass record, proposed new contract and group structure. A change of business unit within one employer is different from moving to another legal company. Shared directors or branding do not answer that question.
Record whether the move involves a related company transfer or a wider corporate transaction. Where the structure is unclear, obtain advice using the company records rather than assuming every group move is treated the same way.
Coordinate the application, cancellation and issuance
For the related-company route, MOM describes a new application followed by cancellation of the existing pass when employment ends, before issuance of the new pass. Follow the applicable instructions and actual approval conditions.
Do not use a desired payroll start date as evidence that work authorisation is complete. Keep the official outcomes and issuance records, and explain any change to the planned start date to the relevant teams.
Example: finance has moved the employee before HR has finished
A group decides that next month’s salary should come from a subsidiary, but the pass and contract still identify the original company. HR, finance and the company advisers need one agreed chronology. Paying from the new entity alone does not establish that the employment transfer was properly completed.
Prepare the cut-off schedule
- Last day employed by the original entity.
- Proposed and authorised commencement with the new employer.
- Final salary, expenses and other amounts owed by the original company.
- Leave and benefits treatment agreed in the documents.
- Pass application, cancellation and issuance actions.
- Payroll, reporting and any tax-clearance review.
Check employment and tax obligations on the actual facts. Do not assume all accrued entitlements or liabilities move automatically because the companies belong to one group.
Keep the two employers’ records separate
Reconcile payments and employee balances to the proper entity. If one group company pays on behalf of another, document the arrangement and relevant intercompany entry. Avoid making the payroll history appear as though the new company employed the person before the actual transfer.
Give the employee clear written information about the employer, role, pay and transition. Legal advice may be needed where contract terms or continuity are disputed.
Is a group transfer a simple renewal?
Do not assume so. Review the actual employer change and prescribed process.
Can payroll decide the work-authorisation start date?
No. Coordinate payroll with the employment and official pass position.
